1. Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of the xavdrilo website (the "Site") and the information provided on it. The Site is operated by Xavdrilo Education Ltd ("xavdrilo", "we", "us", or "our"). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

You must be at least 16 years old to use this Site. If you are under 18, you may use the Site only with the involvement and supervision of a parent or legal guardian. If you do not agree to these Terms, do not use the Site.

2. What the Site provides

xavdrilo is an educational website describing an online course that teaches retail sales skills for clothing and furniture sectors. The Site may include course outlines, module descriptions, example practices, and forms that allow you to request course details or contact us. The Site is lead-generation and information-focused; it is not an e-commerce checkout, and submission of a form does not create an automatic purchase, enrollment, or account.

We may update, reorganize, expand, reduce, or discontinue any part of the Site at any time, including changes to course descriptions, learning materials summaries, and any supporting content. We do not guarantee that any particular content will remain available indefinitely.

3. No professional advice and no guarantees

The Site provides general educational content about retail sales and operations. It does not provide legal, financial, tax, or employment advice. Any examples, scripts, checklists, or operational routines described are illustrative and must be adapted to your store, brand standards, local consumer law, and internal policies.

We do not promise specific commercial outcomes. Retail performance depends on many factors outside our control, including assortment, pricing, seasonality, staffing, training frequency, leadership cadence, and customer demand. Any references to "improvement" are descriptive of learning goals and may not reflect results for every learner or team.

4. Acceptable use

You agree to use the Site in a lawful, respectful, and secure manner. You must not:

5. Intellectual property

You may not reproduce, redistribute, publish, sell, sublicense, or create derivative works from the Site content without our prior written permission, except as allowed by mandatory law.

"xavdrilo" and related names, logos, and marks are trademarks or trade dress of Xavdrilo Education Ltd. No license is granted to use our trademarks without written permission.

6. Third-party services and links

The Site may reference third-party platforms or services in a descriptive way (for example, tools used by retailers). If we provide links to third-party websites, those sites are not controlled by us. We are not responsible for third-party content, availability, or practices. Your use of third-party websites is at your own risk and subject to their terms and privacy policies.

7. Disclaimers of warranties

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

We do not warrant that the Site will be error-free, secure, or free from harmful components. While we take reasonable steps to protect the Site, no online service can be guaranteed fully secure.

8. Limitation of liability

To the maximum extent permitted by law, Xavdrilo Education Ltd and its directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Site.

To the extent that liability cannot be excluded, our total liability for all claims arising out of or relating to the Site will not exceed the greater of (a) the amount you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless Xavdrilo Education Ltd from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Site, (b) your violation of these Terms, or (c) information you submit through the Site that is false, unlawful, or infringes third-party rights.

10. Force majeure

We will not be liable for any delay or failure to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet outages, hosting or cloud failures, or cyberattacks.

11. International use

The Site is operated from the Czech Republic. We make no representation that the Site is appropriate or available in every jurisdiction. You are responsible for complying with local laws that apply to your access and use of the Site.

12. Governing law and courts

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. The courts located in the Czech Republic will have jurisdiction over disputes arising out of or relating to these Terms or the Site. If you are a consumer in the European Union, you may also benefit from mandatory consumer protection provisions in your country of residence.

13. Dispute resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Send a brief description of the issue to [email protected] with the subject line "Terms Dispute". We will respond in good faith and aim for a practical resolution.

14. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms or if your use creates a security, legal, or operational risk. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive termination.

15. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

16. Entire agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Xavdrilo Education Ltd regarding your use of the Site and supersede any prior or contemporaneous understandings on that subject.

17. Assignment

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

18. No waiver

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.

19. Changes to these Terms

We may update these Terms from time to time. Changes will become effective 14 days after being posted on this page, unless a change is required by law to take effect sooner. The "Last Updated" date at the top indicates when the most recent revision was posted.

20. Electronic communications

By using the Site and submitting forms, you consent to receive communications from us electronically (for example, by email). You agree that electronic communications satisfy any legal requirement that such communications be in writing.
